| Summary: | In February 2020, Upasana Mishra moved to Hyderabad, India to work as the business development manager for M/S Dash InfraTech Ltd., a start-up infrastructure project company, mainly engaged in project exports. The export of engineering goods and services on deferred payment terms which led to execution of turnkey projects including civil construction contracts abroad, were collectively referred to as "project exports." Mishra's key responsibility was to scale up the company's operations by expanding into new markets and acquiring new clients. Her specific role was to bid for and negotiate trade contracts with overseas employers (project owners, sponsors), mostly government agencies, vendors and suppliers of raw materials, machines and equipment. She needed to improve business performance and productivity while expanding business volumes, but at the same time minimize supplier risk and cash flow (liquidity) risk inherent in project export contracts. This case allows for a discussion of various concepts relating to bank guarantee as a risk mitigation tool in project exports and other business contracts. |
