Summary:"The purpose of this book is to help psychologists understand the legal bases of liability and the reality of malpractice, and to help them take reasonable steps to limit the risk of malpractice claims. We first deal with the theory and general legal principles of malpractice and then translate those principles into practical ways of avoiding the risk and the unnecessary concerns about professional liability. In the first two chapters, we provide an overview of the law of professional liability, in particular negligence. The next several chapters deal with professional liability and informed consent, confidentiality, diagnosis and treatment, and violence. In a separate chapter, we consider a variety of other areas of practice that give rise to liability. In the last two chapters, we review the trial process and risk management strategies. Because avoiding claims and liability is a focus of this book, most chapters include practical suggestions to assist psychologists in that goal.
