Description
Summary:Defines "employee" and under the National Labor Relations Act (NLRA), which guarantees workers the right to organize, join unions, and bargain collectively; defines unfair labor practices; and designates the National Labor Relations Board (NLRB) to enforce labor law. Examines Oakwood Healthcare, Inc., in which NLRB established new definitions for key terms that are used to identify supervisors, following Supreme Court ruling that prior definitions were inconsistent with NLRA. Summarizes provisions and considers impact of H.R. 1644 and S. 969, both the Re-Empowerment of Skilled and Professional Employees and Construction Tradesworkers (RESPECT) Act, to narrow definition of the term "supervisor" in the NLRA.
