Summary:Summarizes constitutional arguments made for and against State and local economic sanctions against individuals and firms that do business with or in foreign countries whose conduct the jurisdictions find objectionable. Discusses Supreme Court decisions in Crosby v. National Foreign Trade Council and American Insurance Association v. Garamendi, which held that such State laws were preempted by Federal laws; and reviews Federal district court decision in National Foreign Trade Council v. Giannoulias, which held that an Illinois Sudan sanctions law was unconstitutional. Addresses possible legal ramifications of recent case law for future State and Congressional action in this area, and identifies related legislation introduced in the 110th Congress.
