Description
Summary:Tracks development of Cuomo v. Clearing House Association, L.L.C., involving a challenge by national banks and OCC to an attempt by the New York State Attorney General to investigate possible discrimination in real estate lending by certain national banks and their subsidiaries. Concludes with Supreme Court arguments and ultimate ruling that the National Bank Act does not preempt States from bringing judicial actions against national banks to enforce non-preempted State antidiscrimination laws and State consumer protection laws, providing that State authorities do not encroach on visitorial powers of the OCC.
