Summary:Examines challenges to the availability of injunctive relief in patent infringement cases when an injunction's disruptive effects on the public may outweigh the interest in enforcing the patent holder's "right to exclude others" from making, using, offering for sale, or selling the patented invention throughout the U.S., or importing the invention into the U.S. Reviews basic principles of patent law, eBay, Inc. v. MercExchange, L.L.C., and H.R. 2795, the Patent Reform Act of 2005, which would require courts, when determining whether to issue injunction relief, to consider the fairness of the remedy in light of all the facts and relevant interests of the parties associated with the invention.
